Police power must be justified by compelling state interest showing the laws are reasonable, necessary protecting the rights of others, public health and safety, www.ursm.us How does the sale of marijuana to undercover officers affect the safety of others? Why does organized crime control the distribution of marijuana? Lawyers, including the ACLU, haven’t defended fundamental rights caused by the enforcement of the marijuana laws. The marijuana laws have been reviewed by the courts by rational review. Rational review is used by the courts when no fundamental rights are denied. These “persons” have been deprived of their rights for political reasons, without due process of law, no compelling state interest, under color of law.
